A BILL to amend article seven-a, chapter eighteen of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
fourteen-b, relating to allowing an individual who
participates in the teachers retirement system and who,
additionally, serves in the Legislature to pay the retirement
contribution based upon the amount of their legislative
salary.
Be it enacted by the Legislature of West Virginia:
That article seven-a, chapter eighteen of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section fourteen-b, to read as follows:
ARTICLE 7A. STATE TEACHERS RETIREMENT SYSTEM.
§18-7A-14b. Options of certain members to elect to contribute
based upon amount of legislative salary.

Notwithstanding any other provisions of this article to the
contrary, any present member of the retirement system who, as a
member of the Legislature of this state, was limited in the amount
he or she could pay into the retirement system as the result of
having been absent in order to serve as a legislator, henceforth
shall have the option to pay into the retirement system an amount
calculated from the amount of legislative pay received during the
legislative session.

NOTE: The purpose of this bill is to allow an individual who
participates in the teachers retirement system and who,
additionally, serves in the Legislature, to pay the share of the
retirement contribution into the teachers retirement system based
upon their legislative salary.
